Wills and estate planning
What a will does, how to write one, and what your state requires for it to count.
Nevada accepts handwritten wills without any witnesses, and voids gifts to a witness unless two other witnesses signed. Both are worth knowing before you sign.
Unless it is a holographic or electronic will, a Nevada will is invalid unless it is in writing, signed by the testator or by an attending person at the testator's express direction, and attested by at least two competent witnesses who subscribe their names in the presence of the testator.
NRS 133.040
No. NRS 133.040 requires two competent witnesses, not a notary, and notarizing a Nevada will does not substitute for them. A notary is involved only in a separate self-proving affidavit.
NRS 133.040
Yes, and Nevada is unusually clear about it. A holographic will is one in which the signature, the date and the material provisions are written by the testator's own hand, whether or not it is witnessed or notarized. It is subject to no other form, can be made inside or outside the state, and has the same force as a formally executed will. Note that Nevada requires the date in the testator's handwriting, which many states do not.
NRS 133.090
Nevada is among the strictest. All devises in a will to a subscribing witness are void unless there are two other competent subscribing witnesses to the will. So a beneficiary can witness only where two further, disinterested witnesses also signed. The simple course is to use two witnesses who inherit nothing under the will.
NRS 133.060
Every person of sound mind over the age of 18 may dispose of their estate by will in Nevada.
NRS 133.020
NRS § 133.040 (Valid wills: Requirements of writing, subscription and attestation). In writing, signed by the testator (or by an attending person at the testator's express direction), and attested by at least two competent witnesses who subscribe their names in the testator's presence.
