Wills and estate planning
What a will does, how to write one, and what your state requires for it to count.
Wyoming allows witnesses to appear by audio-video technology, and it lets a beneficiary who witnesses keep whatever they would have inherited anyway.
All Wyoming wills, apart from holographic ones, must be in writing or typewritten, witnessed by two competent witnesses, and signed by the testator or by someone in the testator's presence and at their express direction. If the witnesses were competent when they attested, their later incompetence does not prevent the will being probated. Wyoming also permits witnesses to appear in person or by audio-video communication technology.
Wyo. Stat. § 2-6-112
No. Section 2-6-112 requires two competent witnesses, not a notary, and notarizing a Wyoming will does not substitute for them. A notary appears only in a separate self-proving affidavit.
Wyo. Stat. § 2-6-112
Yes. A will that does not meet the ordinary formalities is valid as a holographic will, witnessed or not, if it is entirely in the handwriting of the testator and signed by the testator's own hand. Entirely is the operative word: a printed form filled in by hand does not qualify.
Wyo. Stat. § 2-6-113
Any person generally competent to be a witness may witness a Wyoming will. But no subscribing witness can take any benefit under it unless there are two other disinterested and competent witnesses. The softening is that a witness who would have inherited under intestacy anyway may still receive that portion, up to its value. Use two witnesses who inherit nothing and none of it arises.
Wyo. Stat. §§ 2-6-112, 2-6-115
Any person of legal age and sound mind may make a Wyoming will and dispose of all their property by it, subject to paying debts and to the rights of a surviving spouse and children.
Wyo. Stat. § 2-6-101
Wyo. Stat. § 2-6-112 (Will to be in writing; number and competency of witnesses). In writing or typewritten, witnessed by two competent witnesses, and signed by the testator (or by another in their presence and by their express direction).
